비례대표제는 비례적인가? 정당명부 비례대표제 도입이 법안 발의 및 통과에 미치는 영향

Abstract

이 연구는 비례적 선거제도가 소수집단의 이해관계에 미치는 영향을 세부적으로 검증하고자 한다. 정책의 시행 결과 대신 입법 자체를 분석 대상으로 설정해, 의도와 결과 사이에 존재하는 교란요인들을 제거하고 비례적 선거제도의 직접적 효과를 살펴본다. 이를 위해 헌법재판소의 판결로 2004년도 17대 총선부터 일괄적으로 정당명부 비례대표제가 도입된 한국의 사례를 분석했다. 단절적 시계열 분석을 활용해 제도 도입 전후로 전체 법안, 노동, 여성, 환경 관련 법안의 발의 및 통과에서 나타난 순간적 효과 및 장기적 증감 효과를 검증했다. 분석 결과는 다음과 같다. 선거제도에서 비례성의 증가는 전체적인 입법 활동을 활성화시켰으며, 노동 법안의 통과를 순간적으로 증가시켰다. 여성 법안의 입법 성과에 미친 비례성 증가의 영향은 해당 제도로 인한 여성의 의회 진출을 통해 이루어진 것으로 보인다. 환경 법안의 경우, 발의 및 통과 모두 비례성의 증가가 가장 강력한 영향을 미치는 것으로 나타났다. 한국에서 정당명부 비례대표제는 도입 초기에 소수집단 관련 입법 활동을 대폭 증가시켰으나, 장기적 추세에 대해서는 유의미한 영향을 미치지 못했다.

In this study, we examine the impact of the Proportional Representation(PR) system on the interests of minority groups. By focusing on its legislative consequences rather than on its policy outcomes, our study attempts to minimize the role of confounding factors that exist between the intention and the result. To assess the direct effect of the PR system, we analyze the case of South Korea in which the closed-list PR system was introduced in the 17th general election in 2004 by the Constitutional Court’s decision. Deploying interrupted time-series analysis, we estimate short-term and long-term effects on the moving and passage of all bills and bills related to labor, women, and environment before and after the introduction of the PR system. We find that (1) The increase in proportionality in the electoral system promoted the overall legislation and instantaneously increased the passage of labor bills; (2) The role of the PR system in the legislative outcome of women bills was mediated by the entry of women into the national assembly; (3) For environmental bills, the increase in proportionality had a strong effect on both moving and passage; and (4) the PR system significantly increased legislative activities concerning minority issues at the time of introduction, but its long-term impact was more limited.
